Der Begriff Filmherstellungsrecht wird auch als (Werk-)Verbindungsrecht verstanden, also ein Recht zur Verbindung von Werken aus verschiedenen Werkgattungen, hier: Bildwerke wie Filme + Musikwerke in Form von Einspielungen bzw. Tonaufnahmen. Dadurch wird ein neues Werk geschaffen. Hierfür muß vorliegend dem Filmhersteller das Recht eingeräumt werden, die Musik für den Film zu nutzen. Das Filmherstellungsrecht wird durch die Autoren selbst oder durch einen Verlag eingeräumt, sofern dieser von den Autoren zur Verwertung beauftragt wurde. Auch bei GEMA-freier Musik<\/a> muß man sich immer das Filmherstellungsrecht vom Rechteinhaber explizit einräumen lassen.<\/p>\n
